APPENDIX A NOTICE OF VIOLATION Niagara Mohawk Power Corporation Nine Mile Point 2

CPPR-112 As a result of the inspection conducted on March 3-7,

1986, and in accordance with the NRC Enforcement Policy ( 10 CFR 2, Appendix C), the following Viola-tions are identified:

A.

10 CFR 50 Appendix B Criterion XVI states in part that: deficiencies affecting quality shall be identified and corrected.

The Standard Nuclear Quality Assurance Program SWSQ-AP, section 16 states that major and recurring conditions adverse to quality shall be identified and corrected.

Nonconformance and Disposition Report No.

14791 and 15610 identified four (4) and sixty seven (67) instruments, respectively, which required cable connectors to be repaired.

Contrary to the above on March 5,

1986, 3 additional instruments, 21SCXPT40, 2MSCFT16A and 2CHS"FTlOY, were not identified for repair and were not corrected to meet requirements.

The above violation is a Severity Level IV, Supplement II.

B.

10 CFR 50.55a(h) states in part that:

protection systems shall meet the requirements of the Institute of Electrical and Electronics Engineers (IEEE) Standard 279.

IEEE Standard 279 Section 4.6 states that signals for the same protective function shall be independent and physically separated.

This requirement was reflected in the FSAR and in the electrical installation specification E-061A.

Specifically, the separation for the cable spreading area is 10 inches in all direction or use a barrier.

Appendix A Contrary to the above, on March 5, in a cable spreading

area, the instrument cable, 2EGPNGXOOl, exiting cable tray 2TK55G was 7 to 8 inches from non division cables at penetration 2WC564N14 and the penetration vertically above and there was no barrier between them.

The above violation is a Severity Level V, Supplement II.

10 CFR 50, Appendix B Criterion VI states, in part that:

measures shall be established to control the issuance of documents, such as instructions, procedures, and drawings...and are used where the prescribed activity is performed.

Start-up Administrative Procedure No. N2-SAP-104C, revision 2, section 5.4. 1, specifies that the Test Engineer shall verify that all A/E drawings are current to the drawing index and to stamp the drawing with a Verification Stamp.

Contrary to the above, on March 4, 1986 during a modification to a motor control circuit for the Service Water Valve, 2SWP"FV47B, at least one of three drawings being used was not stamped by the Test Engineer with a verification stamp as required by Procedure N2-SAP-104C.

The above violation is a Severity Level V, Supplement II.

D.

10 CFR 50, Appendix B Criterion XVI states, in par t that:

corrective action shall be taken to preclude repetition of conditions adverse to quality.

During a previous NRC inspection, a Notice of Violation was issued, 410/84-19-03, for damaged safety related instrument tubing.

The licensee's response letter provided long term corrective action to preclude a recurrence of safety related instrument tubing damage.

Contrary to the above, on March 4 and 5, within the Secondary Containment Building, two instrument tubing (instrument tubing K117 and impulse line of 2RHR*PDT24B) were found damaged.

This indicates that the licensee's previous corrective actions were not effective.

The above violation is a Severity Level IV, Supplement II.

Pursuant to the provisions of 10 CFR 2.201, Niagara Mohawk Power Corporation is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including:

( 1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.

Where good cause is shown, consideration will be given to extending this response time.
