Therein you proposed'that the Commissioners approve our categorization of several serious deficiencies in management controls at Pilgrim Unit 1

as an abnormal occurrence.

We concur in your abnormal occurrence determination for Pilgrim.

However, over the years the NRC has uncovered management deficiencies at a number of plants.

For instance, Niagara Mohawk was cited for significant manage-ment deficiencies and material falsifications related to Nine Mile Point (Unit 1).

In the final analysis, Niagara Mohawk admitted to the defi-ciencies in management

controls, paid a fine, and upgraded their controls.

The Niagara Mohawk deficiencies were not categorized as an abnormal occurr ence, nor have other such deficiencies at operating reactors typically been so categorized.

Based upon the above, it would appear that, an abnormal occurrence determina-tion in Pilgrim's case may be perceived to be somewhat arbitrary.

Therefore, we feel that the Commission Paper should clarify the criteria used in such determinations.

In other words, so that we may be consistent, in our findings, we feel that explicit criteria should be developed to aid in this, as well as futur e determinations.

Once developed, consideration should be given to incorporate these criteria into any future revfsion to our policy statement issued February 24, 1977 (42 FR 10950).

We would be glad to discuss this further. If we can be of further assistance, please..advise.
