APPENDIX A NOTICE OF VIOLATION Niagara Mohawk Power Corporation Nine Mile Point, Unit 2 Docket No. 50-410 License No.

CPPR-112 As a result of the inspection conducted October 13, 1981 to November 13, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:

A.

10CFR50, Appendix B, Criterion V states, in part, "Instructions, procedures or drawings shall include appropriate quantitative or qualitative acceptance criteria for determining that important activities have been satisfactorily accomplished."

The Nine Mile Point, Unit 2, PSAR, Appendix D, guality Assurance

Program, Paragraph D.3.3, states, in part, "The program also includes control of material, structures or components to ensure that these items have met predetermined requirements."

Contrary to the above, on November 6, 1981, the inspector discovered a

completed weld data report on Weld ¹6, RCIC ISO 57-6, with hold point acceptance by the g.

C. Welding Inspector of fit-up and weld out, however, the spool pieces covered by the weld data report were still in storage in the containment building in an unwelded condition.

This is a Severity Level V Violation (Supplement II).

10CFR50, Appendix B, Criterion XVI states, in part, "In the case of significant conditions adverse to quality, the measures shall assure that the cause of the condition is determined and corrective action taken to preclude repetition."

The Nine Mile Point, Unit 2, PSAR, Appendix D, guality Assurance

Program, Paragraph D.3.3, states, in part, "The total program conforms with the provisions of the Code of Federal Regulations, Part
10CFR50, Appendix B, effective July 27, 1970, which covers guality Assurance Criteria for Nuclear Power Plants."

Contrary to the above, the cause for thirty five (35) nonconformances written by Stone and Webster between August ll, 1980 and May 31, 1981 relating to concrete curing were not properly determined nor was adequate corrective action taken to preclude repetition.

This is a Severity Level V Violation (Supplement II).

Pursuant to the provisions of 10 CFR 2.201, Niagara Mohawk Power Corporation is hereby required to submit to this office within thirty days of the date of this Notice, a written statement or explanation in reply, including:

(1) the 8112230160 811203,,

Niagara Mohawk Power Corporation corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.

Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.

Where good cause is shown, consideration will be given to extending your response time.

The responses directed. by this Notice are not subject to the clearance

'rocedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
