UNIVERSITY OF TEXAS AT AUSTIN - REVIEW OF THE EMERGENCY PLAN IN SUPPORT OF THE LICENSE RENEWAL OF FACILITY OPERATING LICENSE NO. R-129 FOR THE UNIVERSITY OF TEXAS AT AUSTIN NUCLEAR ENGINEERING TEACHING LABORATORY TRIGA MARK II NUCLEAR RESEARCH REACTOR (TAC NO. ME7694)

Dear Dr. Biegalski:

As part of your application for renewal of Facility Operating License No. R-129, dated December 11, 2011 (a redacted version of the application is available on the U.S. Nuclear Regulatory Commission (NRCs) public Web site at www.nrc.gov under Agencywide Documents Access and Management System (ADAMS) Accession No. ML12156A097), as supplemented, for the University of Texas at Austin Nuclear Engineering Teaching Laboratory (NETL) TRIGA Mark II Nuclear Research Reactor, the NRC staff performed a review of the NETL Emergency Plan, Revision 3, dated December 3, 2009, and submitted by letter dated December 10, 2010 (ADAMS Accession No. ML100120473).

We have completed our review of the NETL Emergency Plan, Revision 3, and concluded that it remains compliant with the regulations and guidance below:

  • Title 10 of the Code of Federal Regulations, 50.34(b)(6)(v)
  • American National Standards Institute/American Nuclear Society-15.16-2015, Emergency Planning for Research Reactors
  • NRC Information Notice 97-34, Deficiencies in Licensee Submittals Regarding Terminology for Radiological Emergency Action Levels in Accordance with the New Part 20, dated June 12, 1997

S. Biegalski We request that you continue to implement your approved Emergency Plan.

The NRC staff has one additional request with respect to the University of Texas NETL Emergency Plan, Revision 3, which was provided with Official Use Only (OUO) markings on the top and bottom of each page, and was withheld from public disclosure in accordance with the NRC policy at that time of submission in 2009. In 2015, the NRC staff provided revised withholding guidance in NRC Regulatory Issue Summary (RIS) 2015-17, Review and Submission of Updates to Final Safety Analysis Reports, Emergency Preparedness Documents, and Fire Protection Documents, and no longer presumptively withholds emergency preparedness documents in their entirety from public disclosure. The NRC staff was unable to redact the current version of the NETL Emergency Plan, Revision 3, due to the OUO markings, and requests that an updated copy of the NETL Emergency Plan, Revision 3, be provided with only those specific areas considered Sensitive Unclassified Non-Safeguards Information marked as such in accordance with the guidance in RIS 2015-17. The NRC staff can then provide a redacted version for public disclosure.
