PETITION TO EXTEND EXPIRATION DATE OF PROVISIONAL OPERATING LICENSE Pursuant to Section 2.109 of the Commission's Rules of Practice, Niagara Mohawk Power Corporation (Niagara Mohawk) hereby requests the Commission to extend the expiration date of its present Provisional Operating License (DPR No. 17). In support of such request Niagara Mohawk states as follows:

1. Niagara Mohawk obtained the aforementioned license on August 22, 1969. Unless the expiration date of such license is extended, the license will expire on February 22, 1971.

2., On April 20, 1970 Niagara Mohawk filed with the Commission an Application to increase the rating of its Nine Mile Point facility from its present licensed rating of 1538MWt to 1850MWt. This Application is still being reviewed by the Commission.

3. In Appendix D (page 29) to its Final Safety Analysis Report, Niagara Mohawk stated that it had made certain commitments about further studies in connection with the aquatic life in Lake Ontario near the Nine Mile Point site. These remaining ecological studies will be conducted in the spring of 1971. In the opinion of Niagara Mohawk such studies are desirable before conversion of its Provisional Operating License to a Full-Term Operating License.
4. Niagara Mohawk is in the process of preparing an Application for the conversion of its Provisional Operating License to a Full-Term Operating License. It is presently anticipated that such Application will be filed with the Commission in 7uly 1971.

WHEREFORE, Niagara Mohawk respectfully requests that pursuant to Section 2.109 of the Commission's Rules of Practice, its present Provisional Operating License

,v be extended for a period of eighteen (18) months or until the Provisional Operating License is superseded by its Full-Term Operating License.
