Dear Mr. Hills:

'i J. Bolen I am pleased to respond to your letter of August 26, 1974, to Mr. L. Manning Muntzing concerning the Council's review and evaluation of the impact on the biota of Lake Ontario caused by the operation of the Nine Mile Point Nuclear Station Unit l.

Your letter requested the accumulation and segregation of data and reports addressing entrainment fish kills, othax'armful effects on biota and compliance or lack thereof with Section 301 of the Federal Mater Pollution Contxol Act Amendments of 1972 (PHPCA) or New York State thermal pollution regulations. I will be very happy to cooperate with this request. The data and rapoxts utilized by the AEC staff for its assessment of the environmental impacts of the continued operation of the Nina Mila Point Unit 1 plant axe referenced in the Final Environ-mental Statement (FES) for this plant and are currently available at the Regulatory offices in Rockville, Maryland.

Significant additional information will also become available by approxi-mately the end of September 1974. At that time the licensee will publish its first annual summary of tha upgraded and augmentated aquatic surveillance program. izd,tinted at the request of the AEC. The licensee will also transmit to my staff copies of appropriate data and reports which it has or will shortly submit to New York State Department of Environmental Conservation pursuant to conditions imposed by the -State in its Section 401 permit under the FtJPCA.

All of tha above information will be made available to you in any manner you desire. However, I suggest an initial perusual at our Rockville offices as the most expeditious way of establishing which information you may wish to obtain for mora detailed evaluation.
