The problem of entrapping fish in the Nine Mile Point Nuclear Station Unit 2 (Unit 2) intake structure and their subsequent impingement on the intake screens has been discussed in detail by the Regulatory staff in the Unit 2,Draft Environmental Statement.

Data on fish killed on the intake screens of Niagara Mohawk's Nine Mile Point Nuclear Station, Unit 1 (Unit 1) are being collected.

Because of the similarity in the design of the Unit 2 and Unit 1 intake structures, these data vere used by the staff as a first approximation in assessing the potential for loss of fish at the Unit 2 intake. The data available to date (including the data in Supplement 1 to the Environmental Report for Unit 1 submitted in March 1973) are insufficient to permit quantitative assessment of fish impingement with reasonable confidence to predict the impact on fish population in the Nine Mile Point area.

Consequently, as part of the conditions on the issuance of a con-stxuction permit listed in the Draft Environmental Statement, the Commission requires that Niagara Mohawk Power Corporation institute monitoring and sampling programs~ considered by the Regulatory staff to be satisfactory, to determine the number~ species .and size of fish killed at Unit 1 and later at. Unit 2.

You are requested to prepare and submit by April 23, 1973, for the Regulatory staff review and approval a plan for such a monitoring and sampling program for Unit I. After approval the piogram is to be promptly- implemented.
