Oz April 9, 1974, the New York State Dcpartmert of Environment .l Conser-vation issued to Niagara Mohawk Power Corporation (NMPC) a certificate pursuant to Section 401(a)(l) of the Federal l'ater Pollution Control Act, as amended (FA'PCA) (33 U.S.C. g 1251, et sea.). The certificate states, in part, that

On October 8, 1974, the Envi~ onment"l Protection Agency published its "Steam Electric Power Generating Point Source Category Effluent Guidelines and Standards," (39 Federal Register 36186) which, among other th ngs, estab-lishes effluent limitations and standards of performance under Sections 301(b) and 306 of the F'ÃP CA .

Dear Mr. Biggane:

On October 12, 1973, the New York State Department of Environmental Conservation issued to Niagara Mohawk Power Corporation (NMPC) a certificate pursuant to Section 401(a) (I) of the Federal Water Pollution Control Act, as amended (FWPCA) (33.U.S,C. $ 1251, et sece.). The certificate states, in part, that

.+** there is no applicable limitation or other limitations under Section 301(b) arid 302 of the Act, and there is no standard under Sections 306 and 307 of the Act applicable to the activity which [NMPC] proposes to conduct"~":.
