Amendments in Title 10, Chapter I, Code of Pederal Regulations, Part I

50, concerning Appendix which sets forth the Nuclear Regulatory Commission's decision regarding numerical guides for design obgectives and limiting conditions for operation to meet the criterion for "as low as practicable" for radioactive materials in light~ater-cooled nuclear power reactors were published by the Commission on May 5, 1975, (40 FR 19439) and became effective on June 4, 197S.

Since your application for a permit to construct Nine Mile Point, Nuclear Station, Unit 1 was filed prior to January 2, 1971, you must submit to the Commission, within a period of twelve months from June g, 1975:

1. Such information as is necessary to evaluate the means employed for keeping radioactivity in effluents to un-restricted areas as low as practicable, including all such information as is required by 50.34a (b) and (c) not already contained in your application; and
2. Plans and proposed technical specifications developed for the purpose of keeping releases of radioactive materials to unrestricted areas during normal reactor operations, including expected operational occurrences, as low as practicable.

The staff is in the process of developing specific procedures which will include consideration of the Appendix I guidelines, and expects to have specific guidance available by September, 1975.

Niagara Mohawk Power Corporation 2 In the interim, we recommend that you develop information which would demonstrate that the design of the equipment installed to maintain control over radioactive materials in gaseous and liquid effluents expected to be produced during reactor operations will conform to I

the Appendix guidelines.

Our request and schedule for specific information will be sent to you after development of the specific review procedures. Ve believe that the information referred to above should be submitted as soon as feasible before June 4, 1976.
