/Xn, Docket No. 50-220 APPLXCATXON TO CONVERT PROVISXONAL OPERATING LICENSE TO FULL-TERM OPERATING LXCENSE OR ALTERNATIVELYTO EXTEND THE TERMINATION DATE OF THE PROVISIONAL OPERATING LXCENSE Niagara Mohawk Power Corporation (Niagara Mohawk or Licensee) hereby applies to the United States Atomic Energy Commission (Commiss ion) 1.

To convert its Provisional Operating License to a Full-Texm Operating License; or 2.

Xn the alternative, if the aforementioned application is not accepted for filing, to extend the termination date of the Provisional Operating License fox such time as may be required for the Licensee.to perfect the fil'ng of the Application to Convert the Provisional Operating License to Full-Term Operating License and have that perfected application fully processed and determined.

Xn support of its Application to Convert the Provisional Operating License to a Full-Term License, Niagara Mohawk states as follows:

1.

Xt filed its Application for Licenses with the United States Atomic Energy Commission (Commission) on April 1, 1964.

On April 12, 1965, it obtained.

Construction Permit No. CPPR-16.

2.

Upon completion of construction, Licensee obtained a Provisional Operating License No.

DPR-17, dated August 22,

1969, which authorized possession,

use and operation of its Nine Mile Point.nuclear facility at thermal power levels up to 1580 megawatts.

By amendment of that license, dated April 14, 1971, Niagara Mohawk was authorized to operate the facility at steady-state power levels up to a maximum of 1850 megawatts (thermal).

By order of the Commission, dated February 2, 1971, Niagara Mohawk's Provisional Operating License was extended until August 22, 1972.

Filed with this application is an exhibit entitled "Technical Supplement to Application for Conversion from Provisional Operating License to Full-Term Operating License."

This supplement, among other things, describes in detail the following matters:

a. 'he operating history of the plant to date; b.

Matters discussed in the ACRS letters of April 17,

1969, June 19, 1970 and February 6,

1971; and c.

A review of the informational requirements of the Commission's Regulations, including both the effective and proposed appendices to Part 50, in order to demonstrate to the Commission that this facility can qualify for a Full-Term Operating License.

Accompanying this application is an Environmental Report for Licensee's Unit l.

Niagara Mohawk believes that these documents support the Application for a Pull-Term Operating License.

20036 N'agara Mohawk notes that Section 2.109 of the Commission's Rules of Practice operates to continue its Provisional Operating License in effect until a final determination on this application has been made.

WHEREFORE, Niagara Mohawk requests that:

1.

The Commission convert Niagara Mohawk's Provisional Operating License No. DPR-17 to a Full-Term Operating Licen -e,. to have expiration date of April ll; 2005, unless superseded or extended by the Commission prior to such expiration date; or 2.

In the event that the Application to Convert the Licensee's Provisional Operating License to a Full-Term Operating License is not accepted for filing, the Commission extend the

'termination date of the Provisional Operating License for such time as may be reasonably required for the Licensee to perfect the filing of the Application to Convert the Provisional Operating License to a Full-Term Operating License and have that, perfect'ed application fully processed and determined.
