Dear Mr. Varga:
Re: Nine Mile Point Unit 2 Docket 50-410 On November 5, 1976 I sent Mr. B. C. Rusche a New York State Geological Survey report relating to two geologic features in the excavations at the Nine Mile Point Unit 2 site and requested that the NRC keep me advised of all actions that are taken toward the resolution of this matter.
You responded 'to my letter on December 6, 1976, enclosed a summary of 'the September 15, 1976 site visit by the NRC staff and stated that the NRC staff was reviewing the State Geological Survey report and would continue to advise me of all NRC actions taken to resolve this matter.

The State Geological Survey has now advised me that, contrary to their recommendation to the NRC, the geological feature in the heater bay area has been covered over.
In view of the State Geological Survey's recommendation and your December 6 response, it is requested that you provide the bases upon which the NRC decision was made to permit the feature to be covered over and an explanation as to why we were not advised that this action was being or had been taken.
H It is also requested that you send me the summary of the Staff's November 4, 1976 site visit that you referred to in your letter.
