UNITED STATES OF AMERICA ATOMIC ENERGY CO'MISSION In the Matter of the NIAGARA MOHAWK POWER CORPORATION (Nine Mile Point, Unit No. 1)
DOCKET NO. 50-220 PETITION FOR LEAVE TO INTERVENE BY THE STATE OF NEW YORK Pursuant to Section 2.715(c) of the Commission's Rules of Practice, Section 274 of the Atomic Energy Act of 1954, as
- amended, and. in accordance with the provisions of the Commission's Notice of Consideration of Conversion of Provisional Operating License to Full-Term Operating License; Notice of Opportunity for Hearing, dated November 22, 1972, the State of New York, acting by and through its Atomic Energy Council, hereby petitions for leave to intervene as an interested state in the above captioned proceeding upon the following grounds:

This proceeding is to consider the application of Niagara Mohawk Power Corporation for a full-term facility operating license which would authorize Niagara Mohawk Power Corporation to possess, use and operate the Nine-Mile Point Nuclear Station Unit No. 1, located in the Town of Scriba, Oswego County, New York State, at its presently licensed steady state power level of up to 1,850 megawatts (thermal) for a period. of 40 years from April 12, 1965.

The interest of the State of New York in the health, safety and environment of its people requires that all matters pertaining to the safety and environmental impact of the nuclear power plant in the above captioned proceeding be thoroughly considered.

Under Section 104 of'he Commerce Law of the State of New York, the Atomic Energy Council is given the functions of coordinating regulatory I
programs of the agencies and instrumentalities of the State affecting atomic energy activities in New York, of coordinating the participation of the agencies and. instrumentalities of the State in the regulatory processes of the Federal Government affecting atomic energy activities in New York State, and of coordinating the presentation of views of such agencies and instrumentalities for consideration of appropriate Federal agencies.
