Dear Mr. Hoss:

I am pleased to respond to your April 4, 1969 request for informa-tion on the Hiagara Mohawk Power Corporation's Nine Mile Point Huclear Station Under the Atomic Energy Act, a nuclear power'eactor undergoes two

, stages of review prior to its operation.

Before a construction permit may be issued, the preliminary design of the plant: must be evaluated and approved.

Subsequently, when the design of the plant has been developed and construction essentially complete,

.a second review is coxducted to 'determine that the plant has been constructed in accord with the construction permit prior to the issuance of a provisional operating license.

The Nine Mile Point Nuclear Station has been under construction since issuance of a construction permit by the Commission on April 12, 1965.

Issuance of the construction permit followed a detailed, review of the plant design features by the Commission's staff and its consultants and the Advisory Committee on Reactor Safeguards QCRS).

A public hearing on the matter was held oa January 19, 1965, at Oswego, Hew York t

The Advisory Committee on Reactor Safeguards also reviewed the application for an operating license for the Hine Mile Point Nuclear Station and reported the results of its review in a letter dated April 17,. 1969, to Chairman Seaborg of the Atomic Energy Commission.

A copy of this letter is enclosed for your information.
