JAMES A. FITZPATRICK NUCLEAR POWER PLANT - ACKNOWLEDGEMENT OF CONTINUATION OF OPERATIONS
Dear Sir or Madam:
In a letter dated March 16, 2016 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML16076A391 ), Entergy Nuclear Operations, Inc. (Entergy),
submitted its "Certification of Permanent Cessation of Operations" in accordance with Section 50.82(a)(1 )(i) of Title 10 of the Code of Federal Regulations (10 CFR) for James A.
FitzPatrick Nuclear Power Plant (FitzPatrick) and stated that it had decided to permanently cease power operations by January 27, 2017.
Subsequently, by letter dated January 4, 2017 (ADAMS Accession No. ML17012A280), Entergy withdrew its "Certification of Permanent Cessation of Operations."
As FitzPatrick has not permanently ceased power operations and has not submitted the "Certification of Permanent Fuel Removal" in accordance with 10 CFR 50.82(a)(1 )(ii), the U.S. Nuclear Regulatory Commission staff acknowledges Entergy's decision to withdraw its certification of permanent cessation of operations and to continue operations at FitzPatrick.
Operations at FitzPatrick continue to be authorized consistent with the existing Renewed Facility Operating License No. DPR-59, which expires on October 17, 2034.
