SUBJECT: NRC INSPECTION REPORT 50-275/98-09; 50-323/98-09 AND NOTICE OF
VIOLATION
Dear Mr. Rueger:
An onsite special inspection was conducted from May 5-7, 1998, to review four potential
unreviewed safety questions associated with component cooling water, auxiliary saltwater and
residual heat removal system modifications and procedure revisions for your Diablo Canyon
Nuclear Power Plant, Units 1 and 2, reactor facilities. Additional NRC staff review of these
issues was conducted through July 21, 1998. The enclosed report presents the scope and
results of that inspection.
A telephone exit was conducted with Mr. Womack and other
members of your staff regarding these issues on July 21, 1998.
The NRC noted that the 10 CFR 50.59 program was not effectively utilized in these cases to
determine whether a proposed design or procedural change represented
a potential unreviewed
safety question or affected the technical specifications.
Design and procedural changes utilized
the 10 CFR 50.59 process as a means of validating design and procedural changes, but did not
correctly provide a licensing basis determination.
The NRC staff did find that the modifications
implemented and procedure revisions were initiated to correct conditions which had resulted in
degraded system conditions or could have resulted in potential operation outside the design
basis.
None of the modifications or procedure revisions resulted in an increase in the
probabilistic risk to the plant.
Two violations are cited in the enclosed Notice of, Violation (Notice) and the circumstances
surrounding these violations are described in detail in the enclosed report. These violations are
of concern because
the regulatory aspects of design and procedure changes were not
appropriately addressed
in the licensing design basis reviews to determine if an unreviewed
safety question was involved or whether the technical specifications were impacted.
Please
note that you are required to respond to this letter and should followthe instructions specified in
the enclosed Notice when preparing your response.
The NRC will use your response,
in part,
to determine whether further enforcement action is necessary
to ensure compliance with
regulatory requirements.
