ENCLOSURE 1 NOTICE OF VIOLATION Pacific Gas and Electric Company Diablo Canyon Nuclear Power Plant Docket Nos.:

50-275 50-323 License Nos.: DPR-80 DPR-82 During an NRC inspection conducted on May 10 through June 20, 1998, a violation of NRC requirements was identiTied.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

Technical Specification 6.8.1.a states, in part, that procedures shall be established, implemented, and maintained for the procedures recommended in Regulatory Guide 1.33, Appendix A, Revision 2. Regulatory Guide 1.33, Appendix A, Revision 2, Section 1.e, recommends procedures for equipment control (e.g., locking and tagging), and procedures for performing maintenance.

Work Order R0180120 directed personnel to obtain an oil sample and refill the oil from AuxiliaryFeedwater Pump 1-2.

Procedure OP2.ID1, "Clearances and Administrative Tagouts," Revision 8, Section 5.2.2, states, in part, to perform the following actions before permitting anyone to start work on equipment covered by the subclearance:

(1) ensure the master clearance is on active status, (2) a walkdown of the clearance is completed to ensure clearance points will'protect the workers and to ensure that the components are in their correct position and tagged, (3) hang red tags on certain clearance points, and (4) report on the clearance.

Procedure OP1.DC18, "Authorization for Equipment Operation and Maintenance,"

Revision 3, Section 5.3, states, in part, that whenever plant equipment is removed from service for maintenance, written authorization from the Unit Shift Foreman shall be obtained prior to removal from service.

Contrary to the above, procedures for performing maintenance and tagging were not implemented in 3 instances.

Specifically, on May 14, 1998, 1.

Work Order R0180120 was not implemented in that oil was drained from Auxiliary Feedwater Pump 1-1 instead of AuxiliaryFeedwater Pump 1-2.

Procedure OP2.ID1 was not implemented in that the work intended to be performed on AuxiliaryFeedwater Pump 1-2 was started prior to ensuring: (1) the master clearance was on active status; (2) a walkdown of the clearance was completed; (3) the red tags were hung on the specific clearance points; and (4) personnel reported on the clearance.

Procedure OP2.DC18 was not implemented in that upon discovery that oil was inadvertently drained from AuxiliaryFeedwater Pump 1-1, work continued without the written authorization of the shift foreman.

This is a Severity Level IVviolation (Supplement I) (50-275/98010-01).

The NRC has concluded that information regarding the "reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence, and the date when full compliance was achieved is already adequately addressed in Inspection Report 50-275:323/98-10.

However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 ifthe description therein does not accurately refiect your corrective actions or your position.

In that case, or ifyou choose to respond, clearly mark your response as a "Reply to a Notice of Violation," and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region IV, 611 Ryan Plaza Drive, Suite 400, Arlington, Texas 76011, and a copy to the NRC Resident Inspector at the facilitythat is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

Because your response willbe placed in the NRC Public Document Room (PDR), to the extent possible, it should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction.

Ifpersonal privacy or proprietary information is necessary to provide an acceptable response, then please provide a bracketed copy of your response that identifies the information that should be protected and a redacted copy of your response that deletes such information.
