ENCLOSURE 1 NOTICE OF VIOLATION Pacific Gas and Electric Company Diablo Canyon Nuclear Power Plant Docket Nos.:

50-275 50-323 License Nos.: DPR-80 DPR-82 During an NRC inspection conducted on January 4 through February 14, 1998, one violation of NRC requirements was identified.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

Technical Specification 6.8.1 states, in part, that procedures shall be implemented for the procedures recommended in Regulatory Guide 1.33, Appendix A. Regulatory Guide 1.33, Appendix A, Section 1.c, recommends a procedure for equipment control (e.g. locking and tagging).

Procedure OP1.DC20, "Sealed Valves," Revision 6, partially implemented this requirement and stated in Section 4.1.7 that "all component seals shall be installed in a manner to physically impede the operation of the component so that its operation requires that the seal be broken.

On non-throttle valves, it is acceptable for some minor movement (less than a half turn of the handwheel) is allowed as long as the seal must be broken to permit significant operation."

Contrary to the above, as of January 7, 1998, Procedure OP1.DC20 was not properly implemented in that the following sealed valves were not sealed so as to prevent operation greater than half of a turn:

The NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence and the date when full compliance was achieved is already adequately addressed on the docket in the enclosed report.

However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 ifthe description therein does not accurately reflect your corrective actions or your position.

In that case, or ifyou choose to respond, clearly mark your response as a "Reply to a Notice of Violation," and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region IV, 611 Ryan Plaza Drive, Suite 400, Arlington, Texas 76011, and a copy to the NRg Resident Inspector at the facilitythat is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).
