Dear Mr. Shaulis:
Your letter dated March 8,
- 1996, requested public comment on the proposed modification to the existing, hazardous waste facility permit through a Class 3
modification for the Diablo Canyon Power Plant (DCPP)'azardous waste treatment and storage.units.
In yo'ur letter you explained that since the Nuclear Regulatory Commission has jurisdication over radioactive materials at DCPP, you were requesting us to review and 'comment on the modification permit.
The NRC has licensed DCPP under 10 CFR Pai t 50 to possess radioactive material.
The NRC understands that,the modification will add existing and additional mixed waste units to the'existing permit and that these will be located in the auxiliary building and the solid radwaste storage building.
These buildings are considered restricted areas under 10 CFR Part 20, and must be controlled by the licensee.
Consistent with their license, DCPP is able to make modifications to the auxiliary and radwaste storage buildings under the authority of 10 CFR 50.59, in that the modification is not an unreviewed safety question.
The NRC therefore has no comments with respect to the modification to their hazardous waste facility permit. If you have further questions, please contact me at (301) 415-1313.
