LITIGATION CONCERNING DIABLO CANYON, UNITS 1

Dear Mr. Rueger:
The NRC has been informed that the Attorney General of the State of California is investigating allegations that Pacific Gas L Electric Company (PGIIE) failed to provide State permitting agencies with complete and accurate information about the effects of the Diablo Canyon Nuclear Power Plant's intake system on ocean life.
In this regard, we wish to remind PG&E of its responsibilities under Part 50 of Title 10 of the Code of Federal Regulations, specifically Section 50.9, to provide the NRC.with information that is complete and accurate in all material respects in support of licensing applications.
If, in the course of the Attorney General's investigation, you identify instances where the information you submitted may not have been complete and accurate,'ou should supplement such information promptly.
Also, we remind PGIEE of its responsibilities under 10 CFR 50.72 and 50.73, for reviewing, evaluating, and reporting to the NRC defects in safety-related equipment, materials and services, no matter when the defects are identified.
