Thank you for your letter of January 9,
1995, requesting that the San Luis Obispo Hothers for Peace be kept informed of matters concerning the three issues identified by the Atomic Safety and Licensing Board (ASLB) for Pacific Gas and Electric (PGKE) to address in connection with their maintenance program in the ASLB's recent decision approving construction pertod recapture for Diablo Canyon.
Specifically, you requested copies of all PG&E reports, communications between PGSE and the staff of the Nuclear Regulatory Commission (NRC),
and NRC staff analyses of these reports and communications.
You also requested the opportunity to comment on the reports.
As you are
- aware, Hothers for Peace is on the NRC service list.
Consequently, all NRC public documents generated concerning Diablo Canyon are sent to Hothers for Peace.
These documents are also placed in the local public document
- room, as are documents generated by PGLE and sent to the NRC on the Diablo Canyon docket.
It is also the NRC staff's understanding that Diablo Canyon distribution includes Hothers for Peace as a matter of agreement between PG8E and the Hothers for Peace.
Thus, Hothers for Peace will be kept informed concerning these matters.
The NRC staff will not,
- however, be soliciting comments on the documents discussed above.
This is consistent with the ASLB's statement in its decision:
We delegate scheduling and confirmation of satisfactory completion of these matters to the NRC Staff.
Such delegation of post-hearing matters is appropriate
- where, as here, they involve deficiencies that should be corrected but which do not pertain to the basic findings necessary to the issuance of a license.
