VIOLATION
This refers to the special
inspection
conducted
by G.
W. Johnston of this
office on November
1 through
December
2,
1994, of the circumstances
associated
with MODE
1 operation of Diablo Canyon,
Unit 2, with three of four safety
injection accumulators
at less
than the minimum pressure
required
by plant
Technical Specifications.
The inspection
included
a review of activities
authorized for your Diablo Canyon Nuclear
Power Plant, Units
1 and 2,
facility.
At the conclusion of the inspection,
the findings were discussed
with members of your staff identified in the enclosed
report.
Areas
examined during the inspection
are identified in the report.
Within
these
areas,
the inspection consisted
of selective
examinations of procedures
and representative
records,
interviews with personnel,
and observation
of
activities in progress.
The purpose of the inspection
was to determine
whether activities authorized
by the license
were conducted
safely
and in
accordance
with NRC requirements.
Based
on the results of this inspection,
certain of your activities appeared
to be in violation of NRC requirements,
as specified
in the enclosed
Notice of
Violation (Notice).
The first violation involved improper entry into
operating
MODEs
1,
2,
and
3 (above
1000 psig) with accumulators
2-2, 2-3,
and
2-4 below the Technical Specification
minimum pressure.
The second violation
involved two examples
where your staff failed to follow procedures
for
establishing
and verifying the boundaries
for a clearance
for your main
system
upgrades.
The third violation involved two examples of
inadequate
procedures
for ensuring timely evaluation of out-of-tolerance
conditions prior to plant restart
and appropriate initial test conditions for
performing accumulator
pressure
instrument
channel calibrations.

These violations are of concern
because
they involve
a failure of three
controls for equipment configuration
management
which resulted
in the restart
of Unit 2 with three accumulators
below the, Technical Specification
minimum
pressure.
These control failures are improper implementation of equipment
clearances,
inadequate
procedures
for surveillance testing,
and
a lack of
prompt corrective actions for nonconforming conditions,
Had any of these
three controls
been effective,
the
mode changes
with inoperable
could have
been prevented.
You are required to respond to this letter
and should follow the instructions
specified
in the enclosed
Notice when preparing your response.
In your
response,
you should
document
the specific actions
taken
and
any additional
actions
you plan to prevent recurrence.
After reviewing your response
to this
Notice, including your proposed corrective actions
and the results of future
inspections,
the
NRC will determine whether further
NRC enforcement
action is
necessary
to ensure
compliance with NRC regulatory requirements.
In accordance
with 10 CFR 2.790 of the NRC's "Rules of Practice,"
a copy of
this letter and its enclosures will be placed in the
NRC Public Document
Room.
