I am responding to your letter to the Chairman dated April 21, 1994, wherein you expressed your concern regarding the NRC's two-year trial program for conducting open enforcement conferences.
In particular, you faulted implementation of the program because open enforcement conferences generally are conducted (in accordance with traditional practice) at NRC regional offices instead of in the vicinity of licensee facilities.
You reiterated your previously expressed concern about the NRC's March 23 enforcement conference held in the former Region V office (now the Walnut Creek Field Office) with the Pacific Gas and Electric Company.
Although you were pleased that this conference was open to the public, you stated that the time and location made it impossible for any members of the San Luis Obispo Mothers for Peace to attend.
You also expressed your hope that the agency would change this practice for future enforcement conferences.
I appreciate your concern and understand the desire of the public to have enforcement conferences as well as other meetings with licensees in the vicinity of licensed facilities.
- However, as previously stated in Mr. Perkins'arch 18, 1994 letter to you, conducting enforcement conferences at licensee sites would have a significant impact on NRC resources, both in time spent in travel and the cost of the travel.
As a Federal agency tasked with protecting the public health and safety, the NRC must balance the public's interest in this aspect of the regulatory process against the NRC's ability to effectively and efficiently carry out its regulatory mission.
Opening enforcement conferences for public observation is intended to provide the public with the opportunity to observe how the NRC conducts this phase of the enforcement
- process, an activity which in the past has been closed to public observation.
The trial program was not intended to modify the normal practice with regard to timing and location of enforcement conferences in order to maximize the possibility of public attendance at such conferences.
However, in an effort to open up the regulatory process to the public, the trial program provides that open enforcement conferences be announced normally at least 10 working days in advance of conferences through notices posted in the Public Document Room and toll-free telephone messages.
In the case of the open enforcement conference involving Diablo Canyon, the NRC specifically notified the Mothers for Peace.
I regret that no one from your organization was able to attend.
