& 2 Complaint of Discrimination Allegation No. RV-89-A-0043

Dear Sir:

This refers to your letter of September 5,

1989 in response to our letter of August 4, 1989 concerning alleged discrimination against an employee for having engaged in protected activities.

Briefly, a

PG&E contractor employee filed a complaint in a state court alleging that his employment involving Diablo Canyon had been terminated in 1987 because he had raised safety concerns to PG&E management.

However, the complaint was settled.

Mhile.the NRC found the safety concerns to have merit in this case, we were unable to substantiate the allegation of discrimination. Accordingly, based on review of information provided and because of the circumstances of this case, we have determined that NRC enforcement action is not appropriate at this time.

No response to this letter is required.

In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice,"

a copy of this letter will be placed in the NRC Public Document Room.
