Docket Nos.

50-275 and 50-323 UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D. C. 20555 November 7, 1990 J)oc~

Nr. Karl Kempton Energy Division Department of Planning and Building San Luis Obispo County City Government Center San Luis Obispo; California 93408

Dear Hr. Kempton:

SUBJECT:

REQUEST FOR RELEASE OF DRAFT USGS REPORT I am responding to your letter of October 1, 1990, which requested that we send you a copy of the draft USGS report on the Diablo Canyon seismic re-evaluation program.

I cannot comply with your request at this time because Agency policy precludes release of draft or pre-, decisional material prior to the conclusion of a review.

The NRC staff is currently reviewing a seismic re-evaluation of the plant that the Pacific Gas and Electric Company (PG&E) recently conducted.

The re-evaluation is also known as the Long Term Seismic Program, or LTSP.

The seismic re-evaluation was conducted by PGIIE to comply with a condition of the Diablo Canyon Unit 1 operating license issued by the NRC to PG5 E in 1984.

The NRC review team consists of a number of NRC staff experts in the areas of geology, seismology, engineering, and probabilistic risk assessment.

To assist with its review, the NRC has retained consultants from universities, national laboratories, the U.S. Geological Survey and several consulting firms.

The staff review team will consider the recommendations of all of its consultants in reaching a decision regarding the adequacy of the seismic design of Diablo Canyon.

When its, review of the Diablo Canyon seismic re-evaluation program is completed, the NRC will document the results in a Safety Evaluation Report (SER).

The USGS is currently reviewing certain aspects of the Long-Term

I wi 11 be pleased to send a copy of the SER, including its appendices, to you when it is issued.

Sincerely, Otig~AQ Sig08~ 8')
