ENCLOSURE 1 NOTICE OF VIOLATION Pacific Gas and Electric Company Diablo Canyon Nuclear Power Plant Docket Nos.:

50-275 50-323 License Nos.: DPR-80 DPR-82 During an NRC inspection conducted on August 2 through September 12, 1998, one violation of NRC requirements was identified. In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

Technical Specification 6.8.1.h requires, in part, that the licensee implement and maintain procedures for the Fire Protection Program.

Procedure OM8.ID2 "Fire System Impairment," Revision 6, partially implements this requirement.

Contrary to the above, as of September 12, 1998, a procedure for the Fire Protection Program was not adequately maintained.

Specifically, Procedure OM8.ID2, Section 3;12.2, contained an inappropriate definition of a continuous fire watch that was implemented at Diablo Canyon.

The definition stated that a continuous fire watch is "a fire watch that monitors the immediate area of a non-functional fire rated assembly at least once per 15 minutes," without any further restrictions for its use.

This is a Severity Level IVviolation (Supplement I) (50-275;323/981 4-02).

The NRC has concluded that information regarding the reason for the violation; the corrective actions taken and planned to correct the violation and prevent recurrence; and the date when full compliance was achieved is already adequately addressed on the docket in the enclosed report. However, you are required to submit a written staten o.~t or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or your position.

In that case, or if you choose to respond, clearly mark you response as a "Reply to a Notice of Violation," and sent it to the U.S. Nuclear Regulatory Commission, ATTN:

~ Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region IV, 611 Ryan Plaza Drive, Suite 400, Arlington, Texas 76011, and a copy to the NRC Resident Inspector at the facilitythat is the subject of this Notice, within 30 days of the date of the letter '.ransmitting this Notice of Violation (Notice).

If you contest this enforcement action, you should also provide a copy of your response to the Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, DC 20555-0001.

Because your response willbe placed in the NRC Public Document Room (PDR), to the extent possible, it should not include any personal privacy, proprietary, or safeguards information so that it can be placed in the PDR without redaction.
