NRC INSPECTION

REPORT 50-275/91-22

AND 50-323/91-22

On September

16-20,

1991, Messrs.

D. Schaefer

and

M. Schuster of this office

conducted

an announced initial inspection of your Fitness-For-Duty

(FFD)

program at Diablo Canyon

Power Plant

(DCPP).

On September

20, 1991, at the

conclusion of the site visit, the preliminary inspection findings were

discussed

with Mr.

D. Miklush, Acting Plant Manager,

DCPP,

and other

members

of your staff identified in the enclosed

inspection report.

On September

25,

1991,

PG8E voluntarily provided

a written response

to many of the preliminary

inspection findings.

This response,

enclosed at Attachment A, was reviewed

in-office on September

27, 1991.

The inspection consisted of selective

examinations

of your Drug Prevention

Policy, Nuclear Plant Administrative Procedure

(NPAP) for your

FFD program,

implementing supplements

to this procedure,

interviews with employees

and

contractors,

observations

of your site collection facilities, and review of

pertinent records

and reports.

Based

on this inspection,

we have determined that the development

and

implementation of your FFD program are responsive to both the spirit and

intent of the

FFD rule,

and that the program is aggressive

and comprehensive.

As described in the enclosed report,

we are pleased to note

numerous

strengths

in your program:

Management's

strong support for the program; professionalism

and technical expertise exhibited by personnel

involved in administering the

program;

employee

awareness

and acceptance

of the program;

and the effective

organization

and operation of the two collection facilities at the site.

However, within the scope of this inspection,

there

was

one area in which your

activities appeared

to be in violation of NRC requirements,

as specified in

the enclosed

Notice of Violation (Notice).

This apparent violation has

been

categorized

into the severity level

as described in the

NRC Enforcement

Policy,

10 CFR Part 2, Appendix C.

You are required to respond to this letter

and should follow the instructions specified in the enclosed

Notice when

preparing your response.

In your response,

you should document the specific

actions taken,

and any additional actions you plan, to prevent recurrence.

After reviewinq your response

to the Notice, including your proposed

corrective act)ons

and the results of future inspections,

the

NRC will

determine whether further enforcement action is necessary

to ensure

compliance

with NRC regulatory requirements.

In addition,

two unresolved

items were identified in your

FFD program

pertaining to your past practice of not submitting blind performance test

samples

for the complete

panel of drugs,

and your failure to report to the

NRC

a confirmed positive test of a contract

Foreman performing supervisory duties.

These

items will be forwarded to

NRC Headquarters

for resolution,

The response

directed

by this letter and the accompanying

Notice are not

subject to the clearance

provisions of the Office of Management

and Budget,

otherwise required

by the Paperwork Reduction Act of 1980,

PL 96-511.

In accordance

with Section

2.790 of the

NRC's "Rules of Practice"

Part 2,

Title 10,

Code of Federal

Regulations,

a copy of this letter and its

enclosures will be placed in the

NRC Public Document

Room.
