APPENDIX A NOTICE OF YIOLATION Pacific Gas and Electric Company Diablo Canyon Nuclear Power Plant Docket Nos.
50-275 and 50-323 License Nos.
DPR-80 and DPR-82 During an NRC inspection conducted on December 4 through December 8, 1989, a
violation of NRC requirements was identified.'n accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C ()989), the violation is listed below:
Technical Specification 6.8.) requires that written procedures shall be established, implemented and maintained covering the activities referenced in the Technical Specification.
One of the activities referenced is the applicable procedures recommended in Appendix A of Regulatory Guide 1.33, Revision 2, February 1978, which includes the fire protection program.
Section 9 of the FSAR defines fire protection program requirements and states that availability of the positive displacement charging pump is required to ensu're safe shutdown in the event that a fire disables the centrifugal charging pumps.
Contrary to the above, before June 1, 1989, there were no administrative procedures requiring operability of positive displacement charging pumps to
'nsure their availability for safe shutdown.
In both of the units, durino past year, the positive displacement charging pumps had each been out of service for at least a three week interval, leaving two charging pumps in the same fire area as the only source of charging.
This is a severity level IV violation applicable to both Units ) and 2
No response is required because the licensee's corrective action for the positive displacement pump was verified'nd is considered satisfactory.
