Dear Mr. Devine:
This is to acknowledge receipt of your Petition, filed May 3, 1984, pursuant to 10 CFR 2.206 of the Commission's regulations.
You have requested that the Commission defer any decisions on whether to permit the Diablo Canyon Nuclear Power Plant to begin ascension beyond 5% power until certain actions are completed.
Your request has been referred to the staff for consideration.
In your Petition you requested that these actions be ordered by the Commission on or before May 11, 1984.
Subsequently, in your letter of May 11, 1984 to the Commission you extended the requested action date to May 25, 1984.
At this time no decision on the authorization for the Diablo Canyon plant to exceed the 5$ power level has been scheduled.
We have initiated an inquiry into the information you have submitted to determine whether any of your requested actions should be taken.
- However, no decision on whether they should be taken will be reached by May 25, 1984, nor is such a decision by that date required or necessary.
We will respond to the substance of your Petition within a reasonable time as provided in 10 CFR 2.206(b).
