20009 In Footnote 2 to the submittal you state that the petition includes affidavits of witnesses without their identities or identifying characteristics.

In discussions with Mr. Shollenberger, Regional Counsel in our Region V Office, you stated that even with the deletions, Attachments 2,

3 and 5 do not provide adequate confiden'tiality if released publicly.

We request that within one week of receipt of this letter, you specify in writing those additional portions of these attachments which you believe should not be made publicly available and the, reasons therefor.

You also should provide an expurgated copy for public release and an unexpurgated copy for our use.

In the mean time, we are holding these three attachments awaiting a final determination on confidentiality.

At that time the staff will take the necessary steps to maintain the unexpurgated document sources in confidentiality.

As is our normal practice in handling 10 CFR 2.206 petitions, a copy of your supplemental petition and the attachments are being provided to the licensee.
