Dear Hr. Fleck:
This replies to your February 7 letter.
The Nuclear Regulatory Commission has licensed full poser operation of Unit 1 st the Diablo Canyon nuclear'oser plant because pacific Gas and Electric Company has met all of the Commission's safety, environmental impact and other requirements and, by law, is entitled to a license.
In the event of a ma)or earthquake on the Hosgri fault, which lies off shore from the Diablo Canyon site, the reactor is designed to be shut down safely.
The legality of the Commission's action was appealed to the U. S. Court of Appeals for the District of Columbia Circuit and was upheld by the Court in a December 1984 decision.
