We recently received the attached letter dated June 23, 1983 from J.
R. Reynolds, Counsel to Joint Intervenors, to H. R. Denton, Director of NRR.
The letter relates to an IDVP meeting with the PGBE Diablo Canyon Project on June 14, 1983.
The NRC was not represented at the meeting.
Among other items the resolution of EOI File 1132 was discussed.
According to the enclosed letter this discussion did not only pertain to the technical aspects of the EOI, but also to the procedure for identification and resolution of the issue.
In particular the letter raises a question concerning the independence of the IDVP in its inter-actions with the Project.
We request that you determine and fully assess the factual circumstances of the IDVP interaction with the Project at the meeting.
This should be based solely on information from IOVP participants.
You should specifically evaluate the events with respect to any actual or apparent influence from the Project on the IOVP representatives.
We also request that you determine and evaluate to what extent, if any, similar circumstances arose at other IDYP/Project meetings and what overall effect such conditions could have on the IDVP.
Finally, we request that you provide or describe the guidance that you had given prior to the June 14 meeting to the members of the IDVP for such situations and what guidance you have provided since the meeting to assure that there will be no influence on the IDVP, apparent or actual'e request that you provide us with the above information as soon as possible.
