Dear Dr. Cooper:

The staff and our consultant, Brookhaven National Laboratories (BNL),

have completed the review of Interim Technical Reports (ITRs) 13, 16, 39 and 40 (Reference 1 through 4).

These reports were prepared by R. L.

Cloud Associates (RLCA) as part of the Diablo Canyon Unit 1 Independent Design Verification Program (IDVP).

In addition, the staff and Btli assisted in a Region V inspection of background information referenced in the reports on June 8, 9 and 10, 1983 at the offices of RLCA.

Based on our review, we have concluded that ITRs 13, 39 and 40 do not adequately address a number of geotechnical issues related to the intake structure and therefore do not provide an acceptable basis for the conclusions contained therein.

Our principal concerns are:

(1)

ITR 13 does not define the material properties of the backfill and therefore the adequacy of the analysis and design cannot be assessed.

(2)

The methodology and the assumptions for determination of soil strength used in ITR 39 to compute lateral earth pressures are, in our opinion, inappropriate for large magnitude earthquakes.

(3)

ITR 40 only verifies the magnitude of the parameters used in the sliding analysis.

Consistent with IDVP objectives, we believe that the ITR should assess the factor of safety against sliding under the Hosgri seismic event.

The concerns listed above were discussed with representatives of RLCA in some detail at the exit interview following the audit.

At that time the staff agreed that these matters are difficult to discuss in a number of ITRs of narrow scope, as was attempted.
