Dear Mr. Palladino:

This communication follows up the earlier letter of inquiry dated October 28, 1981, sent with respect to Diablo Canyon.

One of our chief concerns is to learn as much as possible from these events to guide us in reaching a better understanding as to how the rinci le of'nde endent review of the desi n and construction of critical facilities can best be im lemented in the future.

Regrettable as the Diablo Canyon developments have undoubtedly been to all parties concerned,'t would be even more unfortunate if. we should fail to utilize this case as an opportunity to learn more about (1) the

.need for independent

review, (2) workable formulas.for establishing independent review teams, and (3) ways of insuring that effective reviews are actually carried out.'s noted previously, this Commission has already recognized the importance of independent review of critical facilities by adopting a

policy in its Goals and Policies...

(May 10, 1979) stating in part:

"all new critical facilities... should be subject t'o thorough and independent review and inspection of design and construction."

Prompted in substantial part by its review of geologic hazards in connection with the proposed Auburn'am, on December 13, 1979 the Commission elaborated its policy further, addressed the question of implementation, and affirmed its intention to "monitor the progress of independent reviews for California projects involving critical facilities undertaken by private organizations, and local, State or Federal govern-mental agencies, in order to ensure that sqch reviews are carried out to the satisfaction. of the Commission."

Finally, on November 19, 1980, the Commission adopted a report entitled Inde endent Review of Critical Facilities:

Dam, and treats other recent thinking with respect to independent review.

A copy of the report was enclosed with the October 28 letter

of inquiry.

Just as we learned a great deal from our reviews of Auburn Dam and Warm Springs Dam, we also, hope..to use the Diablo Canyon experience as another excellent opportunity to advance our understanding of independent review, as well as of ways to make it, work more. effectively.

Xt was in that spirit that the earlier letter of inquiry was sent, over the name of my immediate predecessor, Chairman George G. Mader, whom I succeeded on November 12, 1981.

We request that yo'u help us in this endeavor by (1) responding to the earlier Commission inquiry, and (2) giving us the benefit of any other.thoughts you may have with'espect to ways of furthering our objectives.
