This is in response to your recent message to President Reagan expressing your opposition to the licensing of the Diablo Canyon Nuclear Power'lant.
NRC has a mandate to assure adequate protection of the public.health and safety and the implementation of this mandate is our principal concern.
- Indeed, we issued no licenses, following the TMI accident until we were assured that the lessons learned could be suitably incorporated into the plant designs.
Similarly, no full-power licenses are issued without the Federal Emergency Management Agency's review and evaluation of the applicants'mergency preparedness plans.
Extensive public hearings have been held before an Atomic Safety and Licensing Board (ASLB) on various matters concerning the status of Diablo Canyon.
The Hosgri Fault, which is located 2< miles offshore from the Diablo Canyon
- plants, was discovered in 1971 and has been the subject of intensive investigation by the Pacific Gas 8 Electric Company (PG&E), the U.S.
g Geological Survey (USGS) and the Nuclear Regulatory Commission.
As a
-principal geological advisor for the Commission, the USGS in 1975 suggested t'I)at a magnitude of 7.5 be assigned as a potential seismic value for the
. Hosgri Fault.
On September
-26, -1979, the ASLB assigned to conduct the
~licbnsing hearings issued its partial initial decision which found that a 7.5 magnitude earthquake is reasonable
'and meets regulatory requirements.
On July 17, 1981, the Board issued its findings, concluding that operation of the Diablo facility at power levels not to exceed 5X rated power would not pose an un'due risk to the health and safety of the general public.
The NRC issued a
low power license on 'September 22, 1981.
On September 28; 1981, PG8E notified the NRC staff that incorrect verticaf response spectra were used in the design of seismic restraints for certain piping and components.
The Commission suspended the low power operating license on November 19, 1981, and requested that additional information be submitted to assure that the piping and components restraints have been properly designed prior to a decision on re-instating the low power license; I
