Dear Mr.. Salzman:

In accordance with your request during the week of August 10, 1980, I canvassed Counsel for the parties in the Diablo Canyon seismic proceeding with respect to the September 23, 1980 hearing date.

This date was set by the Atomic Safety and Licensing Appeal Board in the Memorandum and Order of August 7, 1980 (ALAB-604). At your request I also obtained information requested by you on the availability of a county facility in San Luis Obispo for the conduct of the hearing.

In my telephone report back to you on August 15, 1980, you advised me of the letter received from Counsel for -Joint Intervenors containing his comments on the September 23, 1980 hearing schedule, and you requested that I advise Counsel for the other parties to submit similar letters expressing their views,with.respect to the September 23, 1980 hearing schedule.

You instructed that these letters from Counsel should consider that the September 23 date would not conflict with the hearings on the security issues that will be scheduled for a time after that date.

I have conveyed your request to Counsel, and this letter is the report of our conversations that you requested.

On behalf of the NRC Staff, I wish to report that the NRC Staff will be prepared to go forward on September 23, 1980, on the seismic issues if that date is retained.
