~O Notice of Intent to Permit an Attorney on Staff of General Counsel to Serve as an Attorney Adviser to the Commission on Securit Plan Matters On February 7,
1979 Ms. Marjorie Nordlinger, an attorney in this office, entered an appearance in the captioned proceeding.
She 'did so at the request of the Commission and ACRS on behalf of two ACRS consultants testifying under subpoena concerning seismic issues.
At that time, at the direction of supervisors in this office, Ms. Nordlinger voluntarily withdrew herself from any future involvement with adjudicatory matters involving these-licenses (Transcript pp. 8821-8822).
Ms. Nordlinger's involvement in the proceeding was brief, extremely limited in scope, and without bias toward any party in the proceeding.
Her role was to protect the ACRS collegial process from unwarranted intrusion in the extremely unlikely event that the Board did not provide such protection, and more importantly, to provide assurance to the ACRS consultants testi-fy'ng that such protection was intended by the Commission.
In this fashion it was believed the Commission could best ensure the integrity of the ACRS process and assure ACRS consultants of the Commission's concern for that process.
Over a year has passed in which Hs. Nordlinger has had no further involvement with the captioned matter.
Two developments have caused me tentatively to decide to assign Hs. Nordlinger duties with respect to this proceeding.
First, the line attorney with previous safeguards experience,
.on leave the academic year of 1978-1979, has on his return requested other assignments and Hs. Nordlinger has become the line attorney chiefly involved with safeguards matters in the Office of General Counsel.
In that capacity she has acted as an attorney adviser to the Commission on'ulemakings relating to safeguarding special nuclear materials and nuclear facilities.
- Second, the Chairman of the Atomic Safety and Licensing Appeal Panel has assigned the seismic proceeding to an Appeal Board different from that 'considering the.Security Plan.

on the Security Plan are going forward on a track separate from t
other matters.
Indeed the Appeal 'Board intends to hold an eviden-I tiary hearing on the Security Plan.

I therefore believe it would be reasonable and fair to assign Hs. Nordlinger to work on safeguards matters in this proceeding that may come before the Commission and tentatively intend to do so.
While I have the view that her original state-ment of intent to abstain was over broad and exhibited an excess of caution, she will continue to refrain from all contact with
any issues in this proceeding that do not arise in the context of the safeguards proceedings.
Ms. Nordlinger has assured me that nothing that occurred in her brief experience attending the hearing on behalf of the ACRS consultant witnesses would in any way bias her work on the safe-f guards matters.
She accepts the assignment provided that the Board and all parties are granted an opportunity to state any objections that they may have and no reasonable objections are made.
In light of the foregoing I request the views within 10 days o
any member of the Board or any party who may wish to provide them. If no objections are received within this time, Ms..Nordlinger will be assumed at liberty to work on this matter..
In the event of any objection I will advise you of my determination regarding it.
