However, the Comnission is proceeding on the Action Plan on the highest priority basis in order to minimize these delays.

G. Hylton I am pleased to respond to your November 8, 1979 letter to the Chairman, Nuclear Pegulatory Cotnaissjon.

Under NRC rules of practice the Chairman and members of the Commission may be called upon to review the orders and decision of the Licensing Board and hence it would be inappropriate for him to conriient on the matters raised in your letter; therefore your letter was referred to me for reply.

In your letter, you inquired as to what delays in the licensing of the Diablo Canyon plants vould result from our evaluation of the issues raised by the President's Cotrmission on TMI.

In Chairman Hendrie' letter to Dr. Frank Press dated November 9, 19?9, a copy of which is enclosed, the Nuclear Regu-latory Comoission has found that actions r ecorrmended.

by the President' Conmission in the areas of human factors, operational safety, emergency planning, nuclear power plant design and siting, health effects and public information are necessary and feasible.

The enclosures to the Chairman's letter provide summaries of=the Cotrmission' preliminary analysis and views.

At this time we are preparing an Action Plan for Commission review and approval which will go beyond the general content of these summaries, specifying the precise actions to be taken.

This Action Plan will include new or improved saf'ety objectives, the detailed criteria for their, implementation and the various implementation deadlines.

Our goal is=to have approved-Coranission requirements available to all utilities shortly after February 15, 1980.

In addition, it is also likely that the present Atomic Safety and Licensing Hearing Board may require further public hearings on public cohtentions related to these requirements.
