MGroff SECY 79-1714 EDO R/F OCA I am pleased to respond to your June 1, 1979 letter identifying contact wfbh representatives of citizens in California who have levelled criticisms at the Diablo Canyon plant.
Since my May 25, 1979 letter to you responding to your April 24, 1979 referral of a constituent's letter has already addressed some of the concerns expressed in your most recent letter, some of the ans-wers here will refer to the May 25th letter.
I should also note that Chair-man Hendvie is responding to your April 2, 1979 letter.
The first identified criticism requested a study of the consequences of a Class IX(9) accident at the Diablo Canyon plant.
The occurrences in Class 9
involve sequences of postulated successive failures move severe than those postulated for establishing the design basis for protective systems and engineered safety features for proposed nuclear power plants.
Their conse-quences could be severe.
However, the probability of their occurrence is so small that their environmental risk is extremely low.
Defense in depth (multiple physical barriers), quality assurance for design, manufacture, and operation, continued surveillance and testing, and conservative design are all applied to provide and maintain the required hfgh degree of assurance that potential accidents fn this class are, and will remain, sufficiently remote in probability that the environmental risk is extremely low.
These
-varfous means for assuring the low probability of a t!lass 9 accident are very thoroughly reviewed and evaluated by the NRC staff during the licensing safety review.
In'ddition, the site must meet certain site evaluation cri-teria specified fn 10 CFR Part 100 - Reactor Site Criteria (see
!3100.11, for example).
The criteria are, determined upon evaluation of a particular fission product release, an expected leak rate fvom containment, application of meteor-ologfcal conditions pertinent to the site.
Based on these
- analyaes, the appli-cant must derive an exclusion
- zone, a low population zone and a population center distance that meet the bases established fn 5100.11 (a), (1), (2) and (3).
The staff has determined that the biab1o Canyon site meets the estab-Qg lished criteria, and has described the site acceptability in the Final Envi-ronmental Statement for the Nab1o Canyon Moc1ear Generation Station (IIav 1973).

With respect to public 'concern regarding the adequacy of the Diablo Canyon plant to withstand earthquakes, that matter was extensively dealt with during the course of the public hearing on the Diablo Canyon application.
Expert testimony was presented to the Licensing Board by parties to the proceeding.
The Licensing Board will take this testimony into account in reaching its decision regarding the application.
The Licensing Board's decision will be subject to appeal and review by the NRC Atomic Safety and Licensing Appeal Board and the Commission.
1 Regarding the emergency plan, the NRC had concurred in the State of California's Ii Plan.
One of the direct supporting documents submitted as part of the Califoroo nba Plan was, the San Luis Obtspo County response plan for nuclear power plants.
5te now look forward to reviewing the emergency preparedness measures being revised by the California Emergency Power Plant Review Panel.
You may be assured that they will be given careful consideration in our evaluation of the adequacy of emergency plans for the Diablo Canyon plant to assure, the public health and safety.
My May 25, 1979 letter discussed our ongoing reviews of the Three Mile Island accident and the planned application of that study to plants that are cur-rently under construction and have applications for an operating license.
In answer to the last item in your June 1, 1979 letter, before considering issu-ance of an operating license for Diablo Canyon, we must determine that there is reasonable assurance that the plant can be operated without undue risk to the health and safety of the public.
