Resolution No. 192 October 13, 2016 RESOLUTION IN SUPPORT OF THE TRANSFER OF OWNERSIDP OF THE JAMES A. FITZPATRICK NUCLEAR POWER PLANT FROM ENTERGY NUCLEAR OPERATIONS INC. TO EXELON GENERATION CO. LLC By Legislator Roy Reehil:

WHEREAS, Exelon Generation Co. LLC has reached an agreement with Entergy _Nuclear Operations Inc. to purchase the 838-MW James A. FitzPatrick nuclear power plant in Scriba, NY; and WHEREAS, the New York State Public Service Commission has adopted a Clean Energy Standard that recognizes the zero-emission attributes of nuclear power production; and WHEREAS, the U.S. Nuclear Regulatory Commission is accepting comment until October 17, 2016 on an application filed by Entergy Nuclear Operations Inc.and Exelon Generation Co. LLC for the transfer of the operating license for the James A. FitzPatrick Nuclear Power Plant from Entergy to Exelon (Docket ID NRC-2016- 0195); and WHEREAS, the New York Power Authority has agreed to transfer the decommissioning f--

w WHEREAS, as the host community for three nuclear power plants sincel 975, Oswego C/J 0

County's communities, businesses, and leaders can attest to the significant economic importance, safety, and environmental benefits of the nuclear power industry; and WHEREAS, the James A. FitzPatrick nuclear plant is an irreplaceable and significant economic driver in the region, employing over 600 people with payroll and charitable contributions exceeding $74 million annually, contributing significant dollars to emergency management and radiological planning agencies, paying $12 million annually in town, coup.ty and school taxes to support critical public and education services; and boosting the local economy during refueling outages that require approximately 1,000 contract workers; and WHEREAS, the James A. FitzPatrick nuclear plant produces 838 megawatts of electricity, making it a critical component of the State's power supply and energy future; and WHEREAS, replacing the plant's production with fossil-fuel plants would result in the emission of24,000 tons of sulfur dioxide, 7,000 tons of nitrogen oxide and 4.6 million tons of carbon dioxide; and

WHEREAS, the continued operation of the Jaines A. Fitzpatdck nuclear plant depends on the transfer of ownership and operating license from Entergy to Exelon, which owns and operates the other two nuclear plants in Oswego County, Nine Mile Point Units 1 and 2; NOW, THEREFORE, BE IT RESOLVED, that the Oswego County Legislature supports the transfer of ownership and operating license of the Jaines A. FitzPatrick nuclear power plant from Entergy Nuclear Operations Inc. to Exelon Generation Co. LLC, and urges the Nuclear Regulatory Commission to approve the companies' application; and be it further RESOLVED, that the Clerk of the Legislature is directed submit a certified copy of this Resolution to the Nuclear Regulatory Commission before the October 17 public comment deadline, and to the Federal Energy Regulatory Commission.
