NRC INVESTIGATION REPORT NO. 1-2015-023

Dear Mr. Richey:

This letter refers to an investigation by the U.S. Nuclear Regulatory Commission (NRC) Office of Investigations (OI) conducted at First Energy Nuclear Operating Companys (FENOCs) Beaver Valley Power Station. The investigation, which was completed on April 28, 2016, was conducted to determine whether a contract security officer employed by Securitas, while working at BVPS, deliberately provided information known to be inaccurate when questioned on the removal of a posted out-of-service (OOS) sign on an explosive detector in the primary access facility.

Based on the evidence gathered during the OI investigation, the NRC concluded that the security officer deliberately provided inaccurate information to FENOC when questioned on the removal of an OOS sign on an explosive detector. Specifically, on March 30, 2015, a security officer placed an OOS explosive detector in-service without noticing that an OOS sign was affixed to the detector. The security officer provided inaccurate information to FENOC on several occasions when she stated that she found the OOS sign on the floor. After being informed by Securitas staff that they had reviewed the video footage that captured the incident, the security officer admitted that she removed the OOS sign from the machine and placed it on the floor next to the detector after she had processed individuals through the OOS detector. In her testimony to OI, the security officer admitted that she provided information she knew to be inaccurate to FENOC and its contractors supervision.

After reviewing the specific circumstances in this case including the fact that the detector was determined to be capable of performing its intended function, the NRC concluded that the individuals deliberate actions did not cause FENOC to be in violation of NRC requirements.

Therefore, the NRC is not taking any enforcement action against FENOC. You are not required to respond to this letter. However, should you choose to respond, your response should be sent to the U.S. Nuclear Regulatory Commission, ATTN: Regional Administrator, Region I, 2100 Renaissance Boulevard, Suite 100, King of Prussia, PA 19406, and marked Open by Addressee Only, within 30 days of the date of this letter, with a copy to the NRC Senior Resident Inspector at Beaver Valley.
