Dear Mr. Gurdziel:
UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 July 22, 2016 I am responding to your email to Nuclear Regulatory Commission (NRC) Chairman Stephen G.
Burns on June 25, 2016, regarding the Indian Point Nuclear Power Station. Your email contained 6 items, some of which have previously been discussed with you. Specifically, items 1 through 4 addressed operational problems associated with circuit breaker replacements, leakage from the safety-related service water piping system, and underground tritium releases.
These issues were previously discussed with you via phone call from the NRC resident inspector office at Indian Point. The purpose of this letter is to respond to the remaining 2 items in your email.
Item 5 in your email requests an explanation regarding why a letter you mailed to the NRC in the February 2016 time frame was returned to you unopened. Earlier this year, NRC staff were informed by their licensing contacts that some letters addressed to the U.S. Nuclear Regulatory Commission, Washington, DC 20555-0001, were being returned to them unopened. Upon investigation, it became evident that this was a sporadic problem that only involved 8.5" by 11" manila envelopes, and that the letters were being returned by the U.S. Postal Service office in Washington, DC and not the NRC mailroom. The issue was discussed between NRC staff and the U.S. Postal Service and apparently resolved as we have not experienced any recurrences.
We are advising that all stakeholders and licensees continue to use the above mailing address in future correspondence with the NRC.
Item 6 in your email requests that the NRC reject the application by Entergy Nuclear Operations, Inc. to relicense Indian Point Nuclear Generating Unit No. 2. In addition, you asked that the NRC staff treat your request in accordance with Title 10 of the Code of Federal Regulations § 2.206, "Requests for action under this subpart." NRC staff guidance relative to handling 2.206 petitions can be found in Management Directive 8.11, "Review Process for 10 CFR 2.206 Petition," (Agencywide Documents Access and Management System Accession No. ML041770328). The Management Directive clearly states that requests to deny a licensing application or amendment will not be considered under 10 CFR 2.206 because there are other proceedings available where an individual's concerns could be addressed. Therefore, while your request to deny relicensing of Indian Point pursuant to 1 O CFR 2.206 is dismissed, I have forwarded your email to the NRC's project manager for the review of the Indian Point license renewal application for consideration as part of that process, as appropriate.
