ZION NUCLEAR POWER STATION LICENSE TERMINATION PLAN

Dear Mr. Rielly:

I am responding to your letter of June 16, 2016, in which you indicated concerns related to the U.S. Nuclear Regulatory Commission (NRC) review of the Zion Nuclear Power Station (Zion)

License Termination Plan (LTP).

You specifically noted, in the e-mail which you copied with your letter, concerns regarding the crib house piping and the proposal to leave the piping in place rather than remove it as part of the site decommissioning. By e-mail dated June 23, 2016, I provided you with a copy of the document, Summary of Environmental Analysis of the Intake/Discharge Structure at the Zion Nuclear Station, as you requested. Regarding the potential for the discharge and intake piping to remain, I want to remind you that the NRC decommissioning regulations only require that a facility be decontaminated to meet our release criteria in 10 CFR Part 20. Our regulations do not require either that a facility be returned to green field or that all the facility structures be removed, and the NRC has no authority to require such actions. In the case of the intake and discharge piping extending into Lake Michigan, any decision to require removal of those pipes would be up the State authorities and/or the Army Corp of Engineers.

In your letter you also refer to publically stated concerns and voids and omissions, related to the LTP submittal. Lacking specifics I am unable to address your concerns at this time. If you would like to provide more specifics regarding the concerns and voids and omissions, I would be able to address those in the future.

In accordance with 10 CFR 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs Agencywide Documents Access and Management System (ADAMS).
