June 28, 2016 EN 16-013 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Exelon Generation Company, LLC EA-16-057 Oyster Creek Nuclear Generating Station Docket No.: 50-219

ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation will be issued on or about July 5, 2016, to Exelon Generation Company, LLC (Exelon) for a violation associated with a White Significance Determination Process finding identified during an inspection of Oyster Creek Nuclear Generating Station. This White finding, an issue of low to moderate safety significance, involves the failure to prescribe instructions or procedures for maintenance on the emergency diesel generator (EDG) cooling water system to ensure the EDG cooling flexible coupling hose was maintained to support the EDG safety function. As a result, the flexible coupling hose was in service for approximately 22 years and subjected to thermal degradation and aging that eventually led to the EDG No. 1 failure during bi-weekly surveillance testing on January 4, 2016.

As a consequence, Exelon also violated Technical Specification 3.7.C, since the EDG No. 1 was determined to be inoperable for greater than the technical specification allowed outage time.

A Notice of Violation is included based on the Technical Specification violation and Exelons failure to meet 10 CFR 50, Appendix B, Criterion V, Instructions, Procedures, and Drawings, which requires, in part, that activities affecting quality shall be prescribed by documented instructions, procedures, and drawings of a type appropriate to the circumstances and shall be accomplished in accordance with these instructions, procedures, and drawings. In accordance with the NRC Enforcement Policy, the NOV is considered an escalated enforcement action because it is associated with a White finding.

In a telephone conversation with the NRC, Region 1, on May 18, 2016, the staff was informed that Exelon did not contest the characterization of the risk significance of the finding and declined the opportunity to discuss this issue in a Regulatory Conference or to provide a written response. Therefore, after reviewing the information developed during the inspection, the staff concluded that the finding is appropriately characterized as White.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
