PROPOSED IMPOSITION OF CIVIL PENALTY - $15,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $15,000 will be issued on or about August 2, 1994 to Duke Power Company. This action is based on a violation identified during an inspection at the Oconee facility May 1 to June 4, 1994, that involved the licensee's failure to implement procedural requirements related to the identification and independent verification of fuel assembly locations during movement of fuel from the spent fuel pool to the Unit 1 reactor core. This resulted in a fuel assembly being retrieved from the wrong spent fuel pool location and subsequently placed in the reactor core; the error was discovered by the licensee's staff later in the refueling sequence and corrected. While the likelihood of significant safety consequences from the violation was low, a civil penalty has been proposed, in accordance with the Enforcement Policy guidance in 10 CFR 2, Appendix C, Section IV.B., due to the recurrent nature of this Severity Level IV violation. Three similar fuel handling Severity Level IV violations, with similar and recurring root causes, have been previously identified at the Oconee facility over the past 3k years.
The civil penalty was neither mitigated or escalated because the Enforcement Policy provides that civil penalties for Severity Level IV violations be normally proposed at the base value without applying the civil penalty adjustment factors.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
Mailing of Notice August 2, 1994 Telephone Notification of Licensee August 2, 1994 The State of South Carolina will be notified.
The licensee has thirty days from the date of the Notice in which to respond. Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
