IMPOSITION OF CIVIL PENALTY -
$100,000 By EN 92-102 dated December 22, 1992, the Commission was notified of the intent of OE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $100,000 to Duke Power Company. The action was based on a violation involving the licensee's failure to take adequate corrective action following the identification of a degraded flow condition during a test of the 3B Low Pressure Injection Cooler.
The licensee responded to the Notice in a letter dated February 25, 1993.
After careful considefation of the licensee's response, the staff has concluded that the violation did occur as set forth in the Notice of Violation and Proposed Imposition of Civil Penalty, and that a sufficient basis was not provided for mitigation of the assessed civil penalty.
Accordingly, an Order Imposing Civil Penalty in the amount of
$100,000 has been issued today. Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
