Good morning Mike and Amy,

This email is to follow up on the recent conversation I had with Amy in regard to the NRCs review of NYSERDAs draft soil sampling report.

As you know, NYSERDA plans to meet with property owners to discuss the soil sampling results prior to the public release of sampling and dose assessment results for individual properties. Before we meet with the property owners, we believe it is important to get input from NRC and the other federal and state regulatory agencies on the sampling and dose assessment results. As you explained, NRC does not accept draft reports for review. You also explained that if NRC were to accept the report for review, NRC would docket the report and make it publicly available before

reviewing it, which would conflict with NYSERDAs commitment to meet with property owners before results for specific properties are made public.

To allow NYSERDA to meet its commitment to meet with property owners and also get NRC input before the results are made public, you suggested that NYSERDA can voluntarily request an NRC audit of the soil sampling results and the soil sampling report while it is a draft document. You said that appropriate NRC staff would review the report, results, calculations, and backup information, and provide NYSERDA with comments, questions, and feedback. Since NYSERDA has no office in the Washington DC area, you said this audit could take place at our office in Ashford, NY. I understand that this pre-submittal voluntary audit would not be docketed.

If my understanding of the voluntary audit process described above is accurate, NYSERDA would like to proceed with the scheduling of the voluntarily audit. Since you mentioned that the voluntary audit would be fee-eligible, I also want to mention that we have not yet received clarification from NRC as to what has changed in regard to circumstances at West Valley that would make NYSERDA subject to licensing fees, since this was not previously the position of the NRC.
