COLUMBIA GENERA TING STATION - WITHDRAWAL OF REQUESTED LICENSING ACTION RE: RELIEF REQUEST SUBMITTED TO NRC FOR ACCEPTANCE REVIEW (CAC NO. MF7548)

Dear Mr. Reddemann:

By letter dated March 30, 2016 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML16090A366), Energy Northwest submitted a relief request for Columbia Generating Station. The proposed relief request would, pursuant to Title 10 of the Code of Federal Regulations (10 CFR) 50.55a(g)(5)(iii), request U.S. Nuclear Regulatory Commission (NRC) approval due to an impracticality of an inservice inspection during the fourth 10-year period. An acceptance review was underway to determine if there was sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review process also is intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Before the acceptance review was able to be completed, in full, by letter dated April 26, 2016 (ADAMS Accession No. ML16117A508), you requested to withdraw the application from NRC review. The NRC acknowledges your request to withdraw the application. NRC staff activities on the review have ceased and the associated Cost Activity Code number has been closed.

The NRC staff notes that its partial review had identified that your application characterized the regulatory requirements for this relief request as a relief request based on alternative rather than one based on a hardship. Therefore, if you decide to re-submit the request, it must be an alternative associated with 10 CFR 50.55a(z)(1) or 10 CFR 50.55a(z)(2). The resubmission has already occurred including an updated characterization of the regulatory requirements and an acceptance review is underway.
