Dear Mr. OClair:

We have reviewed the North Dakota proposed license condition to 10 CFR Part 37, received by our office on February 26, 2016. These requirements were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements of one amendment identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the legally binding requirements with Dale Patrick on March 1, 2016.

As a result of our review, we have six comments that have been identified in the enclosure.

Please note that we have limited our review to the legally binding requirements required for compatibility and/or health and safety. We have determined that if these requirements are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when you revise your legally binding requirements to address our comments, a copy of the revised legally binding requirements be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made by North Dakota, in response to our comments, and provide a copy to Division of Material Safety, State, Tribal, and Rulemaking Programs, NMSS.

The SRS Data Sheet summarizes our knowledge of the status of other North Dakota regulations, as indicated. Please let us know if you note any inaccuracies, or have any comments on the information contained in the SRS Data Sheet. 3 License Condition, Section D 37.41(a)(3) 2013-1 B

Security program ND should revise Section D to substitute the words North Dakota state department of health for the words NRC regional office specified in §30.6 of this chapter in 10 CFR 37.41(a)(3).

ND needs to address the comment above to meet the Compatibility Category B designation assigned to 10 CFR 37.41(a).

4 License Condition, Section F 37.57 2013-1 C

Reporting of events ND should revise Section F to so that

5 License Condition, Section G 37.81(a) - (f) 2013-1 C

Reporting of events ND should revise Section G to so that the words NRCs Operations Center are replaced with North Dakota state department of health.

The words NRCs Operational Center do not appear in 10 CFR Part

37.

ND needs to address the comment above to meet the Compatibility Category C designation assigned to 10 CFR 37.81(a) - (f).

6 License Condition, Section B 37.57(c) 37.81(g) 2013-1 C

Reporting of events Section B of the proposed license condition replaces the word NRC with the phrase North Dakota state department of health in a number of specific locations in 10 CFR Part 37.

In two of those locations - 37.57(c) and 37.81(g) - the proposed language substitutions create a reporting paradox where licensees are required to submit reports to ND by using a method found in 10 CFR 37.7.

ND should revise the proposed license condition to clarify that the reports to ND required by 37.57(c) and 37.81(g) should be sent by an
