VERMONT YANKEE NUCLEAR POWER STATION - EXEMPTION FROM THE REQUIREMENTS OF TITLE 10 OF THE CODE OF FEDERAL REGULATIONS, PART 140, SECTION 140.11(a)(4), CONCERNING PRIMARY AND SECONDARY LIABILITY INSURANCE (CAC NO. MF3980)
Dear Sir or Madam:
The U.S. Nuclear Regulatory Commission has approved the enclosed exemption from specific requirements of Title 10 of the Code of Federal Regulations, Part 140, Section 11(a)(4), for the Vermont Yankee Nuclear Power Station. This action is in response to your application dated April 17, 2014 (Agencywide Documents Access and Management System Accession No. ML14111A400), requesting an exemption to allow a reduction in offsite primary liability insurance and withdrawal from participation in the secondary retrospective rating pool for deferred premium charges no earlier than April 15, 2016.
A copy of the exemption and the Indemnity Amendment are enclosed. The exemption has been forwarded to the Office of the Federal Register for publication.

April 15, 2016 Docket No. 50-271 AMENDMENT TO INDEMNITY AGREEMENT NO. B-49 AMENDMENT NO. 13 Effective April 15, 2016, Indemnity Agreement No. B-49, between Entergy Nuclear Vermont Yankee, LLC, Entergy Nuclear Operations, Inc., and the U.S. Nuclear Regulatory Commission, dated November 30, 1970, as amended, is hereby further amended as follows:
Article VIII of the indemnity agreement is deleted in its entirety wherever it appears in the agreement, and is substituted therein by the requirements of the exemption permitting a reduction in primary financial protection from
$375,000,000 to $100,000,000, and withdrawal from participation in the secondary layer of financial protection.
Item 2a of the Attachment to the indemnity agreement is deleted in its entirety and the following substituted therefor:
