RIVER BEND STATION - RELAXATION OF CONFIRMATORY ORDER

Dear Mr. Olson:

By a letter, dated November 3, 2015, Entergy Operations, Inc., (Entergy) requested that the U.S. Nuclear Regulatory Commission (NRC) relax Action H of the Confirmatory Order issued to Entergy and the River Bend Station on December 3, 2014. The Confirmatory Order can be found in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRCs Agencywide Documents and Management System (ADAMS) under Accession Number ML14339A167, and the November 3, 2015, Entergy letter can be found under Accession Number ML15307A509. ADAMS is accessible from the NRC Web Site at http://www.nrc.gov/reading-rm/adams.html.

Action H of the Confirmatory Order currently states:

Within 4 months from the date of this Confirmatory Order, Entergy will prepare a presentation describing the event that formed the basis for this violation. The presentation will be delivered to the Nuclear Security Working Group and the National Nuclear Security Conference (subject to the acceptance of the conference-organizing committees). This presentation will include, among other subjects, the subjects covered in the non-public Attachment to this Confirmatory Order. Prior to making the presentation, Entergy will provide its proposed presentation to the NRC for its review. The NRC will communicate to Entergy any concerns regarding the presentation within 30 days of submittal. Entergy will deliver the presentation within 12 months of this Confirmatory Order.

In the November 3, 2015, letter, Entergy stated that with the exception of delivering the required presentation to the National Nuclear Security Conference (NNSC), it has satisfied the conditions in Action H of the Confirmatory Order. The letter further explained that Entergy failed to submit agenda items to the organizers of the NNSC by the required date of May 22, 2015, for consideration in the conference held the week of June 9, 2015. Therefore, Entergy missed its only opportunity in 2015 to fulfill the condition of the Confirmatory Order to deliver the presentation to the NNSC, and the next available opportunity will be in the summer of 2016, which is past the Confirmatory Order due date for this action of December 3, 2015.

E. Olson Entergy attributed the failure to timely complete the NNSC presentation to an inadequate change management plan during personnel changes within the Entergy corporate security department. The change management plan associated with this action failed to account for the due dates in relation to the scheduled timing of the NNSC.

As a compensatory measure for the failure to deliver the presentation at the NNSC, Entergy presented the lessons-learned information to all four industry regional security groups during the periodic group conference calls. In addition, Entergy plans to deliver the lessons learned presentation during the 2016 NNSC, subject to the acceptance of the conference-organizing committees.

The subject Confirmatory Order specified that the Regional Administrator, Region IV, may, in writing, relax or rescind any of the conditions of the Confirmatory Order upon demonstration by Entergy of good cause. My staff has reviewed Entergys request and concluded that there are a number of factors which, in combination, amount to good cause for relaxing the order. These factors include: (1) Entergys compliance with the other Action H requirements, (2) the delivery of the lessons learned presentation during the regional security group conference calls, (3) the plan to deliver the presentation to the 2016 NNSC, and (4) the positive results of the NRCs inspection of Entergys corrective actions to date, as documented in NRC Supplemental Inspection Report 05000458/2015409, dated November 2, 2015 (ML15306A420). The NRC remains committed to inspecting the completion of all Confirmatory Order actions and the NRC will include a review of corrective actions taken by Entergy relating to its failure to complete the NNSC presentation in accordance with the original due date.

Therefore, based upon the authority granted to me as Regional Administrator, Region IV, after consultation with the Director of the Office of Enforcement, the requirements of Action H of the Confirmatory Order are hereby relaxed to read as follows:

Within 4 months from the date of this Confirmatory Order, Entergy will prepare a presentation describing the event that formed the basis for this violation. The presentation will be delivered to the Nuclear Security Working Group and the National Nuclear Security Conference (subject to the acceptance of the conference-organizing committees). This presentation will include, among other subjects, the subjects covered in the non-public Attachment to this Confirmatory Order. Prior to making the presentation, Entergy will provide its proposed presentation to the NRC for its review. The NRC will communicate to Entergy any concerns regarding the presentation within 30 days of submittal. Entergy will deliver the presentation by September 1, 2016.

Entergy is not required to respond to this letter; however, if it chooses to provide a response, the response should not, to the extent possible, include any personal privacy, proprietary, or safeguards information so that it can be made available to the Public without redaction.
